Well, I am now trying the e-mail posting feature since I can't get blogger to post.

Anyway. Obama is endorsing Weisner. Interesting for the fact that Weisner once describied the endorsements that Irvin was getting from people who don't live in Aurora as...

"glib support of highly partisan politicians who don't even live in Aurora."

I guess Obama isn't highly partisan and secretly lives in town? Or is it cool when someone with a big name endoreses you Tom?

From the Beacon Story
Obama's endorsement goes against statements the freshman senator made in Aurora just one month ago, when he said he had "no intention of being a king-maker" in the mayoral election because the people of Aurora "are much closer to the issues and know the gentlemen involved."
At the time, Obama said he was inclined to endorse Weisner because he's a Democrat, but he also congratulated Richard Irvin for his second-place finish in the Feb. 22 primary election and called him "a fine young man as well."

Dan Shomon, Obama's political director, said the freshman senator is backing Weisner because he's a progressive Democrat who supported Obama in November and has a lifelong record of community and public service.

Shomon said Obama never said he wouldn't endorse a candidate for mayor.

"The endorsement is not against Irvin, it's for Weisner," Shomon said. "Irvin has also mounted a credible campaign."

-- So besides the label of 'progressive Democrat' AKA Liberal this endorsement should help, but it makes Tom look like a hypocrite on the endorsement thing.

Looking forward to reading the anonymous comments telling me how an Obama endorsement is different than a Tom Cross endorsement and how 'Progressive Democrat' is going to play well.

Well I wonder if Blago is going to go see U of I in the final 4, if so then he might want to make sure he avoids seeing the Chief perform. Because you know he has never seen it him perform.

I hope if he goes later some reporter asks for his opinion about the Cheif once he has seen him perform.

The Beacon has a story about Tom today. Read it, it's mostly positive but does talk about how the former and current mayor of Aurora are both staying out of the race.

Well this is the first time I have actually seen this in writing (or text)

Stover, who had a falling-out with Weisner last year that culminated with Weisner leaving City Hall during the water boil order, said he promised to stay out of the race when he announced in November 2002 that he would not run for re-election.

Anyway the debate on my Irvin mailer thing has been interesting. Remember anonymous folks, I feel Richard would be the better mayor, I have never said anything really negative about Tom. I have made my discomfort about how and why he left the employment of the city clear. Do I think he is a bad man, no. Do I think he is a good guy, yeah. Do I think he would be a really bad mayor, no. Do I think Richard would be a better mayor, yeah.

Lets all just try and remember to be nice to each other.

From the Beacon News

Mayor candidates: Enough is enough

We have witnessed more than the usual share of mudslinging in the race for Aurora mayor this year, and there are signs that the war between the Tom Weisner and Richard Irvin camps might be escalating as we near the April 5 election.

The fliers distributed Thursday by Irvin's campaign might have been the lowest blow in the prize fight so far, but it isn't the only one. Both sides have taken some cheap shots along the way, and both sides need to take responsibility for turning this campaign back onto the high road.

Irvin and Weisner speak passionately about Aurora's image, but if the politics of personal attack, half-truths and outright lies continues, there could be more harm to Aurora's image than any election victory can heal.

We say: Let's put an end to it. Right now.

-- Right on, they will have their endorsement on Thursday. I look forward to reading it. They are also doing some other stuff between now and election day.

Don't forget to vote.

Got some mail today, Irvin and Weisner.
Weisner: Trying to portray Irvin as someone who will increase your taxes.

Irvin: Blames Tom for the Boil Order, doesn't offer any sort of proof that Tom's job had anything to do with the water department. ( I think the Beacon is going to nail him for this).
All in All I think the piece could have been done better and perhaps more accurately as well. I think it will get Richard some votes, but I think it also signals we are going to have a really negative week or so coming up.

There were protests over a pharmacist not providing someone with birth control.

Planned Parenthood, which organized the protest outside the Osco at State and Adams Streets, says the Illinois Health Care Right of Conscience Act does not apply to pharmacists. That law says health-care providers cannot be held liable for withholding treatment that violates their personal beliefs.

But the American Pharmacists Association says pharmacists can't be compelled to dispense a medication to which they have moral objections. Nevertheless, the association says, there must be an alternative system in place to make sure the patient gets the drug her doctor has prescribed.

Colleen Connell of the American Civil Liberties Union in Chicago said there is "no clear legal answer. The issue of whether a pharmacist is a health-care provider under Illinois law has never been litigated."

Ok, I am not an attorney or do I play on my blog, I can recommend some legal bloggers.

Anyway To see the Illinois Health Care Right of Conscience Act follow the link, but I think (again I am not an attorney) that the following in the law just about covers pharmacists.

The bolding is mine
Sec. 1. Short title. This Act may be cited as the Health Care Right of Conscience Act. (Source: P.A. 90-246, eff. 1-1-98.) (745 ILCS 70/2)

Sec. 2. Findings and policy. The General Assembly finds and declares that people and organizations hold different beliefs about whether certain health care services are morally acceptable. It is the public policy of the State of Illinois to respect and protect the right of conscience of all persons who refuse to obtain, receive or accept, or who are engaged in, the delivery of, arrangement for, or payment of health care services and medical care whether acting individually, corporately, or in association with other persons; and to prohibit all forms of discrimination, disqualification, coercion, disability or imposition of liability upon such persons or entities by reason of their refusing to act contrary to their conscience or conscientious convictions in refusing to obtain, receive, accept, deliver, pay for, or arrange for the payment of health care services and medical care. (Source: P.A. 90-246, eff. 1-1-98.) (745 ILCS 70/3)

Sec. 3. Definitions. As used in this Act, unless the context clearly otherwise requires:

(a) "Health care" means any phase of patient care, including but not limited to, testing; diagnosis; prognosis; ancillary research; instructions; family planning, counseling, referrals, or any other advice in connection with the use or procurement of contraceptives and sterilization or abortion procedures; medication; or surgery or other care or treatment rendered by a physician or physicians, nurses, paraprofessionals or health care facility, intended for the physical, emotional, and mental well-being of persons;

(b) "Physician" means any person who is licensed by the State of Illinois under the Medical Practice Act of 1987;

(c) "Health care personnel" means any nurse, nurses' aide, medical school student, professional, paraprofessional or any other person who furnishes, or assists in the furnishing of, health care services;

Since it takes at least 4 or 5 years of education to be able to sit for the pharmacy exam in this state, ( usually you end up with a Pharm.D degree) I think they would qualify as professional, since they are sued for malpractice, have to get CE credits (for fun topics like Use of Long-Acting Opioids for the Management of Chronic Pain. Makes them health care professionals. Finally the fact that the pharmacist is supposed to advise you on how to take your medications as well as warn you of possible reactions with other medications you might be taking makes them health care professionals.

Sorry in my opinion, pharmacists are health care professionals and are covered by the law.

The Trib story had this at the end.
Dr. Debra Stulberg, a family physician in Oak Park who attended the demonstration, said she assesses each patient's medical needs and comes to a decision with the patient about what to prescribe. When pharmacists refuse to fill her prescription, she said, "they're getting in the way of the best interests of my patients."

Sorry doctor, the day pharmacists just fill prescriptions without having the right to have their own ethical objections and/or feel comfortable questioning the treatment of a patient I get worried. Everyone in the health care process, doctor, nurse, pharmacist should be able to exercise their ethics and ask questions if necessary.
The Beacon has a story today about the money in the Aurora Mayor race.

As of March 6, Weisner had $116,698 on hand, compared to Irvin's $13,297. As of that date, excluding loans, Weisner and Irvin had raised through the course of their campaigns a total of $280,361 and $102,170, respectively.

Or another way to think about it over $2 per registered voter in the city...

From the Sun Times
Gov. Blagojevich and Mayor Daley have had a strained relationship from the moment the governor took office, but the two powerful Democrats have tried to soft-pedal their differences in public.

Last week, the pretenses were dropped.

Then this from the Trib..
In the state's current budget, Chicago gets more than one quarter of Illinois' $1.5 billion schools budget, though it has less than 20 percent of the state's students. Millions more dollars flow through the Department of Public Health for specialized care geared to the city.

Chicago's share of state income taxes has remained untouched despite huge state budget deficits. And while state universities say they are strapped for cash and cutting back, Chicago State University is receiving an extra $1 million for special programs.

So even tho they don't get along the city seems to do farily well...

Could this 'rift with the mayor' be part of a presidential plan for Blago to make him look good by standing up to the mayor without really standing up to him...

Then again...

Today's Openline is truly surreal, seriously it blows my mind, it's moments like these I think it is good voter turn out is so low. Read em all here but there is a triple header of great ones.

The news today is students are tense enough to snap over upcoming SAT tests. They better put their genius to good use and figure an end to nuclear proliferation, or they can relax — there is no future to be stressed out over.

-- The holidays must have be fun at this guys house. Merry Christmas Timmy, Santa was going to get you a bike but since he figures were all going to die anyway what's the point.

Reopen Alcatraz
In the case of the Judge Lefkow murders, all judges take heed and stop being lenient with all these hard-core criminals. Re-open Alcatraz Island and put them like it was years ago. Why was that prison closed in the first place? The government has to explain to all victims of this nature. Some people should be locked up permanently as they do not belong in this society.

-- Ummm, the guy who shot the Lefkow family wasn't a hard-core criminal, he was a hard core nut job. Also Alcatraz was closed for cost reasons, the federal government operates at least two prisons in the US that are at least as secure and even tougher than Alcatraz was. Finally, we do lock quite a few people up in this country permanently...

Finally a shout out to Arch since I know he finds Lauzen so entertaining...

School financing
Chris Lauzen has come out and said that he is against finding other means to finance schools than real estate taxes. Apparently he thinks this is a good idea. If he was really interested in rolling back and helping people with out-of-control real estate taxes, the schools are the biggest part of our real estate tax bill. So if we could actually find another way of financing our schools, as other states have done, then maybe we would get some relief. But instead, Mr. Lauzen seems dead set on keeping this archaic system of financing our schools.

-- Umm writers who's name I removed because I felt like it. Chris Lauzen has in fact proposed a radical change to the property tax system SB2079 that would freeze your assesment on your home until it was sold and at that time it would be reassessed. So basically the increase in your property tax would be limited to changes in the tax rates, not the value of your home. So in fact, right or wrong, Sen. Lauzen has proposed a real change to the system. I doubt it will get out of rules, but all the same he has made a real proposal.

I am seriously considering trying to write a column for the Beacon News called. Refuting OpenLine (or at least making that a blog).

SD 204 in Naperville, Aurora, etc is looking for another tax increase. The No folks have a web site so do the yes folks.

The want to build a new High School cost ($90 million), that's $20 million more than the new high school in Oswego cost 2 years ago. The cost of the land for the site is another $19.6 million and is a prime piece of real estate (Route 59 and 75th st in Naperville).

Don't really have a strong feeling on this one (it's not my district).

The fact that I will live closer to two and perhaps even three high schools in a neighboring district that I do to one of the two high schools in my own district based off where they want to put the new 204 HS is kind of funny. Also the land they picked seems to an expensive hunk of land to take off the property tax rolls.

Southern Illinois University law professor Sheila Simon, daughter of the late U.S. Sen. Paul Simon; and Joe Moore Jr., who runs a public relations firm in Chicago, start in July.

-- That only took 7 freakin months, amazing considering how fast he was able to come up with names the video game advisory board really quick

Back to committees it took long enough to fill...

Now the Education Funding Advisory Board is having a meeting tomorrow! He added new members on 2/23. Good work Student's first Illinois I kind of wish at least one of the members of the committee was from a school district (or even an area) with serious funding issues. Like the High School district I attended 205 in Cook County, for what it's worth not only Thornton had success in Speech and Drama, Thornridge has more than it's share of state trophies in those areas (more than basketball and football combined). Too bad the district can't even afford a yearbook program anymore.

Governor if you want to show some leadership on education funding, put Dr. Buckner on the board.

It's quite fun looking at the daily filings with the state board of elections for each candidate for mayor. Lots of 'partnerships' giving in the race right now. Richard seems to be seeing more money from elected officals. Tom is doing ok with union money to say the least.

Also got polled (asked who I was going to vote for) by someone from the Weisner campaign.

The Trib has some stuff about the debate on the Video Game bill (read the entire thing) but I enjoyed this bit...

Under the bill, retailers would be forbidden from selling or renting to teenagers video games that are sexually explicit or that depict images of human-on-human violence. Does that mean games that merely blast space creatures are OK? asked Rep. Robert Molaro (D-Chicago).

"Killing an alien wouldn't fall under the bill," said Rep. Linda Chapa LaVia (D-Aurora), the sponsor.

Would that apply to all aliens or only those who "just look like humans?" Molaro then asked.

"If it's an alien that looks like a human, which is an alien, yes," Chapa LaVia responded.

Later, she refined her interpretation this way: "If it was an alien that pretended to be a human, I guess then it's human. Then it would fall under this bill because it's human against human. ... How would we know he was an alien?"

-- So shooting a stormtrooper(tm) in a Star Wars game (it is a human inside the uniform) that would make the game such that I can't sell it to a 17 year old, but If I modify the game so you are just shooting Wookies and Ewoks you can sell that to a 10 year old?

Linda, what if it involved shooting Bambi? Is that ok?

I look forward to someone using the Wookie Defense

From Openline in the Beacon News today..

Police in wartime
We're in a time that we're at war with the terrorists that could illegally come into the country, and at this time a quote from the newspaper would be that Aurora Cmdr. Michael Gilloffo said that "We don't enforce immigration. We don't ask people about their citizenship. That's the bottom line." He seems to be proud of it. Also, the police departments of this country receive federal money, and with the war, we need to check these people, and if they don't have identification they should be turned over to immigration.

There are a few of these, they came in response to a story in the Beacon that mentioned the police did some safety stops and they arrested some people, but they were not arresting people for being illegal immigrants.

My first comment to the openline commenter, If you were pulled over by the police how would you prove you were a US citizen? Do you carry your birth certificate, passport? Your drivers license you say? That doesn't prove anything if you are from some states. What if you are riding your bike and don't have your drivers license with you?

Next Comment: If the police asked everyone they encountered if they were a US Citizen, it would become open season on illegal emigrants in Aurora. Hey I can rob you (or much worse) because if you go to the police you will be deported. Heck people don't go to the police now because they are afraid of that, it will get much worse if it became part of the active process of the police to look for illegal immigrants.

Sounds like not turning the police into the INS sounds like a good idea to me.

I got sick of doing the math but just Fayette,Cumberland,Clark and Effingham alone have about 83,000 people so let us just assume the enitre area may have 150,000 people so he can't find 1 out of 15,000 people to sit on the board in the area?

The governor shook a couple of hands, then pointed at me. "Nattering nabobs of negativism, right there!" he declared.

THE ALLITERATION WAS compliments of Spiro Agnew, the GOP vice president who resigned from Richard Nixon's administration amid scandal. Agnew used it to describe the press corps during a speech in 1970.

Equal taxation
Rod Blagojevich ought to tax toilet paper. That way everybody, including welfare recipients, would be taxed with everybody's fair share instead of imposing taxes on all the luxuries, such as cigarettes, hotel taxes, food and beverage taxes. It would be fair for everyone. So what is the point if I can buy pot cheaper than I can buy a pack of cigarettes? (I pulled the name out)

Because you know, poor people don't buy food or beverages so therefore they pay no taxes. Also at one time you needed to get tax stamps for your pot. Also how do you know you can get pot cheaper than a pack of smokes?

Those gosh darn poor people are so lucky, we do things like make sure they don't live in filth and give their kids lunches at schools at they don't have the common courtesy to pay income tax on income they don't have.

(Fixed some spelling and grammar)

Ok, we have a bill on Violent and sexually explicit video games, sponsored by my own state rep Linda Chapa-LaVia. I have respect for any state rep that sponsors HB1318 ( a good Samaritan law for Engineers who help out during disasters).

That having been said, I still fail to understand the full logic behind the video game bill HB4023

The Beacon News has this bit..
Although Chapa LaVia said she has heard critics say the legislation would infringe their First Amendment rights, she believes most of her constituents would support the bill. The bill, she said, is comparable to the "parental advisory" stickers on explicit music CD's or movie rules that ban minors from seeing R-rated films without a parent.

-- How do I put this, WRONG!!!

For one thing the 'R' rating is for those under 17. A 17 year old can go see an R rated film without any criminal legal risk to speak off to the movie provider, heck even an NC-17 rating means 17 year olds can get in without a guardian 18 or older.

So a 17 year old can go buy a movie that shows the two of the specific issues that the bill deals with and the retailer is not in criminal jeopardy.

You don't face a specific law and/or fine for selling a '2Live Crew' CD or 'Scarface' on DVD to someone.

From the Bill
(e) "Violent" video games include realistic depictions of
human-on-human violence in which the player kills, seriously
injures, or otherwise causes serious physical harm to another
human, including but not limited to depictions of death,
dismemberment, amputation, decapitation, maiming,
disfigurement, mutilation of body parts (took a word out here so filters don't block the site)

(e) "(another blocked word) explicit" video games include those that the
average person, applying contemporary community standards
would find, with respect to minors, is designed to appeal or
pander to the prurient interest and depicts or represents in a
manner patently offensive with respect to minors, an actual or
simulated sexual act or sexual contact, an actual or simulated
normal or perverted sexual act or a lewd exhibition of the
genitals or post-pubescent female breast.

Also with this description, I would think that 'Star Wars Battlefronts' as well as a host of other games would be covered under the Violent portion of the act, I am assuming we will leave it to the courts to determine what is 'Realistic'?

So under this law a 17 year old can buy a DVD of a movie that also has several people get shot (ie, Scarface) but if the same clerk sells him 'Doom' the sales clerk can be fined.

Also it looks like that if you sell someone a used game via eBay you could also be liable...

Again it sounds nice but why only videogames, if we are that worried about our kids, why not something for DVD's? Music with Tipper Stickers?
